Judicial Discretion in China: Balancing Power and Justice
The judiciary plays a pivotal role in China's rule of law, serving as the essential mechanism for the law to exert its influence on social governance. All legal cases necessitate court filing and subsequent judgment by a judge. The intrinsic limitations of the law stem from the inherent conflict between its stability and the ever-changing nature of societal development. This conflict presents judges with a persistent dilemma during judicial trials – the imperative to issue judgments even when the law lacks explicit provisions or clarity.
In practice, the inherent lag of the law, ambiguity in legal provisions as the law's medium, and disparities in personal interpretation inevitably lead to complex and challenging cases, often resulting in legal gaps and unclear laws. This is where the concept of judicial discretion emerges. However, China's current legal framework lacks a clear definition of judges' discretion and fails to establish a system of institutional mechanisms that safeguard the responsible exercise of discretion while preventing its abuse. Unrestrained discretion inevitably undermines judicial fairness. Therefore, a pressing issue in China's rule of law development is how to refine the regulatory system for judicial discretion to effectively minimize its misuse.
This article delves into this crucial issue in four distinct parts. First, it provides a conceptual understanding of discretion, defining its essence as a judge's free choice, applicable during the stages of fact-finding and legal application. The second part examines the current state of judges' discretion and the factors that limit its exercise. The third part, building upon the second, elucidates the challenges and limitations of discretion in practical application. Finally, considering the actual trial experiences of Chinese judges, it concludes that judicial discretion should be subject to strict legal constraints. This can be achieved by enhancing judges' professional ethics, reinforcing their commitment to justice, and rigorously regulating through legal procedures.
Simultaneously, to ensure substantial justice, discretion should be modestly expanded within a framework of regulation. This article concludes with institutional design suggestions to foster the progression of a rule-of-law society.
