This case is an action brought by XXX Original Plaintiff against XXX Defendant for termination of the lease contract, in which the plaintiff applied for a judgment from this court for the defendant to immediately terminate the lease contract and return the leased property occupied by the defendant to the plaintiff, and compensate for the losses suffered by the plaintiff.
I. Lease Contract Signed by Plaintiff and Defendant
On November 30th, 2014, the plaintiff and the defendant signed a valid lease contract, in which the defendant agreed to lease the property owned by the plaintiff for a price of 1000 yuan per month for a period of three years, and the defendant should return the leased property (i.e. the house) to the plaintiff upon expiration of the contract.
II. The Defendant Has Not Returned the Leased Property According to the Contract
On November 30th, 2017, the contract expired, however, the defendant has not returned the leased property to the plaintiff according to the contract and failed to perform the obligations of the lease contract properly, violating the provisions of the contract.
III. The Plaintiff's Request
The plaintiff requests that this court shall make a judgment for the defendant to immediately terminate the lease contract, return the leased property occupied by the defendant to the plaintiff, and compensate for the losses suffered by the plaintiff.
