Bohai Sea Pollution Incident: Vessel Fined for Illegal Discharge

On August 4th, 2023, the Maritime Safety Administration (MSA) of China imposed a fine on a vessel for violating pollutant discharge regulations in the Bohai Sea. The penalty ranges from 50,000 to 80,000 RMB. This decision follows a meeting where the incident was reviewed.

The case highlights the ongoing debate surrounding the Bohai Sea's legal status. While the 'DISCHARGE STANDARD FOR WATER POLLUTANTS FROM SHIPS' (GB3552-2018) defines 'INLAND WATER' as encompassing rivers, lakes, reservoirs, and other surface water bodies within China's territory, the baselines for the Bohai Sea waters remain unannounced.

Term 4.1 of GB3552-2018 mandates that all sewage generated by vessels in 'INLAND WATER' be collected and prohibits discharge into the sea. Historically, the MSA has considered the area west of the connecting line between Lao Tie Shan's west corner and Penglai Jiao as 'inland water,' enforcing a strict no-discharge policy for ship waste within this zone.

The LAW OF MARINE ENVIRONMENTAL PROTECTION stipulates a fine between 20,000.00 and 100,000.00 RMB for such violations. This incident emphasizes the need for clarity regarding the Bohai Sea's legal definition and consistent application of environmental regulations to prevent future pollution incidents.
