y shall not engage in performance sponsoring activities without obtaining government approval, and shall not delegate performance sponsoring activities to other entities or individuals without government approval. 2. The performance brokerage institution shall strictly abide by the relevant laws, regulations and policies of the People’s Republic of China, and shall not engage in any activities that violate laws, damage social morality, or endanger the national security and public interests. 3. The performance brokerage institution shall provide true and complete information about the performance project to the performing groups and individuals, and shall not deceive or mislead them by false information or promises. 4. The performance brokerage institution shall sign a written contract with the performing groups and individuals, and shall clearly define the rights, obligations and legal responsibilities of the two sides for their common observation. 5. The performance brokerage institution shall provide necessary support and assistance to the performing groups and individuals during their performance activities, and shall ensure their safety and legitimate rights and interests. II. The Promise of Performing Groups and Individuals 1. The performing groups and individuals shall strictly abide by the relevant laws, regulations and policies of the People’s Republic of China, and shall not engage in any activities that violate laws, damage social morality, or endanger the national security and public interests. 2. The performing groups and individuals shall perform their performance activities in accordance with the approved project and contract, and shall not change the content, form and time of the performance without the consent of the performance brokerage institution and the relevant government departments. 3. The performing groups and individuals shall respect the social customs, cultural traditions and moral standards of the People’s Republic of China, and shall not engage in any behaviors that are offensive or disrespectful to the host country and its people. 4. The performing groups and individuals shall respect the intellectual property rights of others, and shall not infringe upon the copyright, trademark, patent or other intellectual property rights of any third party. III. The Legal Responsibilities 1. In case of any violation of the laws, regulations and policies of the People’s Republic of China by the performance brokerage institution or the performing groups and individuals, the Shanghai Administration of Culture, Radio, Film and Television shall have the right to impose administrative penalties, such as warning, fine, confiscation of illegal gains, revocation of license, and so on, according to the severity of the violation. 2. In case of any dispute or breach of contract between the performance brokerage institution and the performing groups and individuals, the two sides shall resolve the dispute through negotiation or mediation. If the dispute cannot be resolved through negotiation or mediation, the two sides may apply for arbitration or file a lawsuit to the relevant arbitration institution or court. 3. The performance brokerage institution and the performing groups and individuals shall bear their own legal responsibilities for any infringement of the intellectual property rights of any third party, and shall indemnify the infringed party for any losses or damages caused by the infringement. IV. The Effectiveness and Termination 1. This letter of notification and promise shall come into effect upon the signature of both parties, and shall remain valid until the completion of the performance project and the fulfillment of all contractual obligations. 2. This letter of notification and promise may be terminated by either party upon written notice to the other party in case of force majeure, such as natural disasters, epidemics, wars, and so on, or in case of breach of contract by the other party. 3. The termination of this letter of notification and promise shall not affect the legal responsibilities of the parties for any violation of the laws, regulations and policies of the People’s Republic of China or any breach of contract before the termination. V. Other Provisions 1. Any amendment or supplement to this letter of notification and promise shall be agreed upon by both parties in writing. 2. Any matters not covered by this letter of notification and promise shall be subject to the relevant laws, regulations and policies of the People’s Republic of China. 3. This letter of notification and promise is written in both Chinese and English, and both versions shall have equal legal effect.
