Article 5 The state shall strengthen the supervision and administration of production safety, establish and improve the safety supervision and administration system, and promote the construction of a safe production environment. Article 6 The employees have the right to participate in the production safety management of the production operation units, to know the production safety situation, to make suggestions, and to report the production safety violations. Article 7 The state shall encourage and support scientific research and technological development relating to production safety, and promote the application of scientific and technological achievements in production safety. Article 8 The state shall establish and improve the emergency rescue system for accidents, and strengthen the ability of emergency rescue and disposal. Article 9 The state shall establish and improve the production safety education and training system, enhance the safety awareness of the employees, and improve their safety production skills. Article 10 The state shall establish and improve the social assistance system for the families of the employees who died or were injured due to production accidents. Chapter II Production Safety Guaranties for Production Operation Units Article 11 The production operation units shall implement the safety responsibility system, establish and improve the safety management system, and ensure the implementation of safety production measures. Article 12 The production operation units shall formulate and implement the production safety rules and regulations, and ensure that the employees and other relevant personnel comply with them. Article 13 The production operation units shall establish and improve the safety production accountability system, and ensure that the safety production responsibility is implemented at all levels. Article 14 The production operation units shall establish and improve the safety inspection and supervision system, and ensure the safety of the production facilities and equipment. Article 15 The production operation units shall establish and improve the safety education and training system, enhance the safety awareness of the employees, and improve their safety production skills. Article 16 The production operation units shall establish and improve the safety accident reporting and investigation system, and report and investigate the accidents in a timely and accurate manner. Article 17 The production operation units shall establish and improve the emergency rescue and disposal system, and ensure the ability of emergency rescue and disposal. Article 18 The production operation units shall establish and improve the safety supervision and management system for the contractors and subcontractors, and ensure the safety of their production activities. Chapter III The Rights and Obligations of the Employees Article 19 The employees have the right to know the production safety situation, to participate in the production safety management, to make suggestions, and to report the production safety violations. Article 20 The employees shall abide by the production safety rules and regulations, and ensure the safety of their own production activities. Article 21 The employees shall report the production safety violations and accidents in a timely and accurate manner, and cooperate with the investigation and disposal of the accidents. Article 22 The employees who discover and report the production safety violations and accidents shall be protected by law. Article 23 The employees who are injured or disabled due to production accidents shall enjoy the corresponding legal rights and interests. Chapter IV The Supervision and Administration of Production Safety Article 24 The state shall establish and improve the production safety supervision and administration system, and strengthen the supervision and administration of production safety. Article 25 The production safety supervision and administration shall be carried out by the competent administrative departments of production safety under the State Council and the local people’s governments at various levels. Article 26 The production operation units shall accept the supervision and inspection of the production safety supervision and administration departments, and provide the relevant information and materials truthfully. Article 27 The production safety supervision and administration departments shall carry out the supervision and inspection of the production operation units in accordance with the law, and impose administrative penalties on the violations of production safety laws and regulations. Article 28 The production safety supervision and administration departments shall investigate the production accidents in a timely and accurate manner, and deal with the accidents according to the law. Article 29 The production safety supervision and administration departments shall establish and improve the information disclosure system for production safety, and disclose the production safety information to the public in a timely and accurate manner. Chapter V Emergency Rescue for an Accident and Its Investigation and Disposal Article 30 The emergency rescue for an accident shall be carried out in accordance with the emergency rescue plan. Article 31 The production operation units shall organize and carry out the emergency rescue for the accidents in a timely and effective manner, and minimize the losses caused by the accidents. Article 32 The production safety supervision and administration departments shall guide and supervise the emergency rescue for the accidents, and provide technical support and assistance. Article 33 The investigation and disposal of the accidents shall be carried out in accordance with the law. Article 34 The production operation units shall cooperate with the investigation and disposal of the accidents, and provide the relevant information and materials truthfully. Article 35 The production safety supervision and administration departments shall investigate and deal with the accidents in a timely and accurate manner, and impose legal liabilities on the violations of production safety laws and regulations. Chapter VI Legal Liability Article 36 The production operation units and the relevant personnel who violate the production safety laws and regulations shall be subject to administrative penalties according to the law. Article 37 The production operation units and the relevant personnel who cause losses to the employees or other relevant parties due to production accidents shall bear civil liabilities according to the law. Article 38 The production operation units and the relevant personnel who cause crimes due to production accidents shall be subject to criminal liabilities according to the law. Chapter VII Supplementary Rules Article 39 This Law shall come into force on November 1, 2002. Article 40 The Regulations on Production Safety Supervision and Administration issued by the State Council on December 28, 1992 shall be abolished
